29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program, as described in paragraphs (c) through (o) of this section, whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level (TWA) of 85 decibels measured on the A scale (slow response) or, equivalently, a dose of fifty percent.    a. On or about August 9, 2013 the employer did not develop and implement a hearing conservation program for an employee that was exposed to noise as an eight-hour time-weighted average of 94.8 dBA dBA while using a "Makita" 2414NB (number 082126K) chop saw for cutting metal profiles to manufacture steel trusses in the Metal Truss Building.    b. On or about August 9, 2013 the employer did not develop and implement a hearing conservation program for an employee that was exposed to noise as an eight-hour time-weighted average of 92.3 dBA while using a "Fabbrica Macchine Bergamo" Tritan band saw (serial number D01661) for cutting metal profiles to manufacture steel trusses in the Metal Truss Building.    c. On or about August 9, 2013 the employer did not develop and implement a hearing conservation program an employee that was exposed to noise as an eight-hour time-weighted average of 87.72 dBA while using a "Fabbrica Macchine Bergamo" Tritan band saw (serial number D01661) for cutting metal profiles to manufacture steel trusses in the Metal Truss Building.
