29 CFR 1910.95(c)(1): The employer shall administer a continuing, effective hearing conservation program, as described in paragraphs (c) through (o) of this section, whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level (TWA) of 85 decibels measured on the A scale (slow response) or, equivalently, a dose of fifty percent. For purposes of the hearing conservation program, employee noise exposures shall be computed in accordance with appendix A and Table G-16a, and without regard to any attenuation provided by the use of personal protective equipment. (A) At Universal Manufacturing: The employer failed to establish a hearing conservation program. Employees were exposed to noise levels higher than 85 dBA Action level for noise. (1) Gaming ticket printer: An employee was working at the printer was exposed to continous noise level at 129.2% of the allowable 8-hour time weighted average sound level of 85 dBA or an equivalent sound level of approximately 90.8 dBA. The sampling was performed for 555 minutes during one shift on August 29, 2013. This sample does not include the 45 minutes of time not sampled. (2) An employee working was exposed to continous noise level at 75.5% of the allowable 8-hour time weighted average sound level of 85 dBA or an equivalent sound level of approximately 87.3 dBA. The sampling was performed for 553 minutes during one shift on 29 August, 2013. This sample does not include the 42 minutes of time not sampled. (3) An employee working was exposed to continous noise level at 66.2% of the allowable 8-hour time weighted average sound level of 85 dBA or an equivalent sound level of approximately 85.5 dBA. The sampling was performed for 595 minutes during one shift on August 29, 2013. This sample does not include the 0 minutes of time not sampled, this is zero do to the employee not taking a lunch break.

29 CFR 1910.138(a): General requirements. Employers shall select and require employees to use appropriate hand protection when employees' hands are exposed to hazards such as those from skin absorption of harmful substances; severe cuts or lacerations; severe abrasions; punctures; chemical burns; thermal burns; and harmful temperature extremes. (A). Universal Manufacturing: The employer failed to select and require the appropriate level of hand protection. In the folding area, on 8/22/13: Employee had recieved 1st and 2nd degree burns to her forearms and hands when contacting the glue application heads that keep the glue temperature approximatly 350 degrees F.

Except as provided in paragraphs (f)(7) and (f)(8) of this section, the employer shall ensure that each container of hazardous chemicals in the workplace is labeled, tagged or marked with either: (A) Universal Manufacturing; Employer failed to ensure all containers containing hazardous chemicals were properly labeled. Some of the hazardous chemicals that were not labeled are: - Allied Hydrolic Oil ISO 68, group 1 - WD-40 - Waxes paraffin and hydrocarbon CAS# 8002-74-2 - Wax, polyethylene CAS# 9002-88-4
