29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing hazards and taking corrective action)    Serrano Construction and Development Corporation - Naval Base Guam Bldg. 3179 (Ops Storage) - on or about August 14, 2013 and at times prior thereto, the site competent person did not identify existing hazards and take corrective action when:   - The Lincoln Power Arc 5500 Arc Welder was allowed to be used with exposed copper wire on both weld output cables;  - The competent person did not ensure the supervisor/firewatch/alternate Site Safety Officer remained at their post as a fire watch during welding activities where flammable materials, consisting of oily cardboard to cover controls and a cardboard box with welding rods, were located inside the scissor lift while he was welding.  Sparks capable of igniting the cardboard and burning the welder were being generated.

29 CFR 1926.351(b)(4): Welding cable(s) in use were in need of repair:   Serrano Construction and Development Corporation - Naval Base Guam Bldg. 3179 (Ops Storage) - on or about August 14, 2013 and at times prior thereto, the electrode and work cables adjacent to the lugs attached to the Lincoln Electric AC Generator - AC Stick Welder Power Arc 5500 Arc Welder with serial number 11404 U1071105217, were missing the insulation required to prevent exposure of the copper wire bundle to moisture and contact with other metal while the employee was using the welder.  The Lincoln Electric Power Arc 5500 was located outside during rainy weather and being used by an employee welding a metal partition inside the building.

The scaffold was observed on August 11, 2013 with a green tag at the ladder access area of the scaffold.
