29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them):        (a) Perez Construction, Inc.. @ 9787 Olathe St., Commerce City, CO 80122: On and before August 3rd, 2013, the controlling employer did not ensure a safety program was developed and implemented for the work environment to include regular inspections of the job-site, materials, and equipment; conducted by a competent person. Subcontractor roofing employees on-site were permitted to work in areas where fall hazards existed without an adequate fall protection system. Subcontractor employees were also using ladders that were inadequate to gain access to the roof. The condition exposed subcontractor employees to fall hazards of approximately 18 feet.       Abatement Note: OSHA defines a "competent" person as one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.

29 CFR 1926.501(b)(13):  Each employee engaged in residential construction activities 6 feet (1.8m) or more above lower levels were not protected by guardrail systems, safety net system, personal fall arrest system, or other approved alternative fall protection system:       (a)Perez Construction, Inc.  @ 9787 Olathe St.,  Commerce City, CO 80122:  On and before August 3rd, 2013, the controlling employer did not ensure that subcontractor employees engaged in framing activities on a singlei-family home under construction were utilizing a fall protection system. This condition exposed employees to a fall hazard of approximately 18 feet while standing on the exterior top plate.
