29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): (a) 3rd Floor - Worker were observed doing framing work while standing on the top plate of a wall frame that was 11 feet 6 inches off the floor without hooking off their personal fall arrest system, on or about August 22, 2013. (b) 3rd Floor - Worker were observed doing framing work without hooking off their personal fall arrest system on a floor where the perimeter was not fully guarded thereby exposing the workers to a 42 feet 9 inches fall hazard, on or about August 22, 2013. (c) 1st Floor Rear - Worker stored their supplies in an area where the guardrail was missing its mid-rail without using fall protection and they were exposed to a 7 feet fall hazard, on or about August 22, 2013.

29 CFR 1926.1052(c)(1)(ii): Stairways having four or more risers or rising more than 30 inches (76 cm), whichever is less, were not equipped with a stair rail system along each unprotected side or edge: (a) Front of Building - Workers were observed using a stairway with 5 risers to access the building that was missing a stair rail and exposed to an impalement hazard, on or about August 22, 2013. (b) 2nd Floor - Workers were using a stairway with 16 risers to access their 3rd floor work area that was missing its stair rail on the unguarded open side, on or about August 22, 2013.
