OSH ACT of 1970 Section (5)(a)(1):  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing injuries:    a)  On or about August 23, 2013, and at times prior, the employer did not ensure employees were safe from crushing hazards from a tipping retaining wall made of stacked cement blocks in the ferrous sorting area where fluff falls to the ground from a conveyor and where employees must walk and operate skid steers to remove the fluff.
