29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladders length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: (a) Front of the Building - on or about August 27, 2013 - a fall hazard of approximately 8 feet, 5 inches existed on site. The ladder that was used as access to the main roof did not extend the requisite 3 feet above the upper landing.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): (a) Front Gable of the Building - on or about August 27, 2013 - no conventional fall protection was available for the employees that were performing roofing work on 10 on 12 pitched roof deck. Ground to eave elevation was approximately 8 feet, 5 inches. (b) Left side of the Building - on or about August 27, 2013 - no conventional fall protection was available for the employees that were performing roofing work on a 6 on 12 pitched roof deck. Ground to eave elevation was approximately 18 feet, 9 inches. Bluman Roofing, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard, 29 CFR 1926.501(b)((132), which was contained in OSHA inspection number 313763500, citation number one, item number three and was affirmed as a final order on July 11, 2011, with respect to a workplace located at 176 Washington Avenue, Albany, NY 12205.
