Bluman Roofing LLC was previously cited for violation of this occupational safety and health standard or its equivalent standard, 29 CFR1926.501(b)(13), which was contained in OSHA inspection number 1059104, citation number 2, item number 1 and was affirmed as a final order on 6/11/15, with respect to a workplace located at 5 Mystic Lane, Saratoga Springs, NY 12866. 29 CFR 1926.1053(b)(1): Where (a) portable ladder(s) was/were used for access to an upper level landing surface and the ladder's length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder: a) Roof - On or about September 11, 2015, employees were exposed to fall hazards when accessing the top roof using an aluminum extension ladder that extended approximately 2 feet above the deck of the roof.
