29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them): AGR Building Inc, at 932 Gapter Road, Boulder, CO: On 8/30/13, AGR Building Inc did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them). AGR Building Inc directed the work of Eligio Martinez Hernandez Construction LLC during the construction of a new multistory home. Employees of Eligio Martinez Hernandez Construction LLC were performing framing work on the home. Employees of Eligio Martinez Hernandez Construction LLC were exposed to multiple fall hazards. AGR Building Inc did not maintain a safety program which included frequent and regular inspections of the jobsite. This condition exposed employees of Eligio Martinez Hernandez Construction LLC to fall hazards of approximately seventeen feet, twelve feet, and eleven feet.
