29 CFR 1926.1053(b)(1): Where (a) portable ladder(s) was/were used for access to an upper level landing surface and the ladders length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder.   On September 10, 2013, employees a ladder that did not extend three feet past the upper landing they were accessing, exposing employees to a fall.   Abatement certification is required of this item in accordance with the requirements of 29 CFR 1903.19(c).

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):      Instance 1. On September 10, 2013 employees were not protected from fall while installing plywood sheeting to the roof of a residential property, exposing employees to fall hazard of 21 feet.      Instance 2. On September 10, 2013 employees were not protected from fall while installing rafters on a residential property, exposing employees to a fall hazard of 11 feet 7 inches.    Instance 3. On September 10, 2013 employees were not protected from fall by a guardrail while working around an open windows, exposing employees to a fall hazards between 6 feet and 8 feet 8 inches   Instance 4. On September 10, 2013 employees were not protected from fall by a guardrail while working around an open basement stairwell, exposing employees to a fall hazard of approximately 8 feet.   Bosco Custom homes, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard CFR 29 1926.501(b)(13), which was contained in OSHA inspection number 815101, citation number 01, item number 02a, and was affirmed as a final order on April 17, 2013, with respect to a workplace located at 4075 teak Ct. Naperville, IL 60565.     Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).
