29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels are not protected by guardrail systems, safety net system, or personal fall arrest system, nor are employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   The employer does not protect each employee engaged in residential construction activities 6 feet or more above lower levels.   This most recently occurred on or about June 9, 2014 and June 10, 2014, at the above addressed jobsite. Employees are exposed to fall hazards while performing framing and carpentry operations on a residential property.  Instance 1.        Employees constructing the ridge and rafters on a residential property are not protected from falling, exposing employees to a fall hazard of nineteen (19) feet.  Instance 2.        Guardrails are missing from the second floor front windows while employees are lifting materials through the windows, exposing employees to a fall hazard of fourteen (14) feet two (2) inches.  Instance 3.        Employees sheeting the second floor of a residential property are not protected from falling, exposing employees to a fall hazard of eleven (11) feet.   To abate this hazard in the future, the employer must ensure that fall protection equipment is available and used when employees are working at heights 6 feet or more above lower levels.  The employer has been cited for this practice that included: Bosco Custom Homes, Inc., was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13) which was contained in OSHA inspection number 815101, citation number 1, item number 2A, issued on March 13, 2013, and became final order on or about April 17, 2013, with respect to a workplace located at Ashwood Park, 4075 Teak Court, Lot 76, Naperville, IL 60565, and OSHA inspection number 864645, citation number 1, item number 1, issued on March 13, 2013, and became final order on or about April 17, 2013, with respect to a workplace located at 11514 S. Century, Plainfield, IL 60544, and OSHA inspection number 940669, citation number 2, item number 1, issued on October 22, 2013, and became final order on or about December 11, 2013, with respect to a workplace located at 741 Winged Elm, Elgin, IL 60120.  Pursuant to 29 CFR 1903.19, the employer must submit documents describing the steps it is taking to ensure compliance, including an explanation of how these steps protect its employees from falls.
