Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that the employer allowed a Hyster forklift to be operated without the use of the operator protection device (seatbelt): a) Greenridge Forest Products, 3255 Franklin Pike in Cochranton, PA. On or about September 11, 2013, a Hyster 80 forklift (Model:80XM, Serial Number KOO5DO179OW) was operated by an employee without using the operator protective device (seat belt). The forklift fell into a loading dock, ejected the employee, and rolled over killing him.
