29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system: (a) On or about September 17, 2013, for employees exposed to fall hazards of up to approximately 20 feet, 10 inches, while installing shingles next to an unprotected edge of a residential roof located at 3000 Dortmund Avenue, Bismarck, North Dakota. Note: B & B Roofing was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard which was contained in OSHA Inspection Number 314700485, Citation 1, Item 1, and was affirmed as a final order on January 7, 2011, with respect to a workplace located at 5925 Apple Creek Drive, Bismarck, North Dakota.

29 CFR 1926.503(c)(3): The employer did not retrain each affected employee where the employer has reason to believe that an affected employee who already had been trained does not have the understanding and skill required by paragraph (a) of this section: (a) On or about September 17, 2013, for employees exposed to fall hazards of up to approximately 20 feet, 10 inches, while installing shingles next to an unprotected edge of a residential roof without adequate fall protection systems in place located at 3000 Dortmund Avenue, Bismarck, North Dakota. Note: B & B Roofing was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard which was contained in OSHA Inspection 314700485, Citation 1, Item 2, and was affirmed as a final order on January 7, 2011, with respect to a workplace located at 5925 Apple Creek Drive, Bismarck, North Dakota.
