OSH Act of 1970 Section 5(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that caused or were likely to cause death or serious physical harm in that employees were exposed to combustible metal dust explosion, deflagration, or other fire hazards while working at or near dust collection systems consisting of two outdoor air-material separators (filter media dust collectors) and associated ductwork which were not selected, designed, installed to prevent or minimize employee exposure in the event of an internal deflagration or other uncontrolled fire event:     (a)  Select-Arc, Inc. in Fort Loramie Ohio; On or about November 26, 2013, the outdoor Torit Downfllo II Model 3-6 filter media dust collector servicing the flux room lacked means of (1) explosion protection and (2) deflagration propagation protection (isolation) to the upstream process ducting, the downstream return air ducting, and the unit's hopper discharge.      (b)  Select-Arc, Inc. in Fort Loramie Ohio; On or about November 26, 2013, the outdoor Donaldson Torit TD573 filter media dust collector serving as a central vacuum for the drawing area flux room lacked means of (1) explosion protection and (2) deflagration propagation protection (isolation) to the upstream process ducting and the unit's hopper discharge.

29 CFR 1910.22(a)(1): All places of employment, passageways, storerooms or service rooms were not kept clean and orderly or in a sanitary condition.    a) On or about September 17, 2013, the employer did not ensure that the beams, ductwork, drawing machines and other horizontal structures inside the Drawing Area were maintained in a clean condition. Beams, ductwork, and other horizontal structures above the drawing lines had become accumulated with dust that was composed of metals such as but not limited to, aluminum, magnesium, chromium, and manganese.

29 CFR 1910.178(c)(2)(vi)(a): The employer did not provide powered industrial trucks designated as EX for use in an atmosphere in which combustible dust is or may be in suspension continuously, intermittently, or periodically under normal operating conditions, in quantities sufficient to produce explosive or ignitable mixtures, or where mechanical failure or abnormal operation of machinery or equipment might cause such mixtures to be produced.    a) Select-Arc, Inc. located in Fort Loramie, Ohio; On or about November 26, 2013 the employer failed to ensure that only approved power operated industrial trucks designated as EX were used in atmospheric conditions in which combustible dust was or may have been in suspension under normal operating conditions or where mechanical failure or abnormal operation of machinery or equipment might cause such mixtures to be produced. Employees were exposed to explosion and fire hazards inside the flux room in that a Crown electric forklift was used to lift and pour metal powder into an accumulator.
