29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them): (a) Brookline Builders LLC at 2845-2839 W. 52nd Ave., Denver, CO 80221: On and before July 10, 2013, the controlling employer did not ensure a safety program was implemented for the work environment to include regular inspections of the job-site, materials, and equipment; conducted by a competent person. Three subcontractor employees were working next to the edge of the garage roof and on a pump jack scaffold at a multi-family residential home without the use of a fall protection system. The subcontractor employees were siding the exterior wall of the 2nd level of the home. These conditions exposed employees to fall hazards of approximately 11.2 and 16.9 feet to the ground below.
