29 CFR 1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system. Or, on roofs 50-feet (15.25 m) or less in width, each employee was not protected by use of a monitoring system: On or about September 17, 2013, during roofing activities including but not limited to installation and removal of roofing material, the employer did not ensure all employees on the roof were using a fall protection system/device on a flat roof with a fall height approximately 16 feet.

The warning line was below 34 inches on the front of the building.

29 CFR 1926.503(c)(3): Inadequacies in an affected employee's knowledge or use of fall protection systems or equipment indicate that the employee has not retained the requisite understanding or skill: On or about September 17, 2013, during roofing activities including but not limited to installation and removal of roofing material, the employer did not ensure all employees who were working on the flat roof retained the knowledge of the fall protection requirements while performing roofing activities on a low sloped roof. The warning line was below 34 inches on the front of the building and employees were working outside the warning line with no safety monitor.
