OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that:    a. On or about October 24, 2013, on the east side of the structure, an employee used a wooden job made ladder without filler blocks inserted between the rungs to support the cleats, exposing himself to a 10-foot fall hazard.     Among other methods, one feasible and acceptable method to correct this hazard is to, but not limited to the following: (1) conform to the American National Standard Institute (ANSI) A14.4-1992, section 4.5.2.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):     a. On or about October 24, 2013, on a 4:12 pitch roof, an employee performing siding operations was not protected from a 10 feet 6-inch hazard by use of a guardrail system, safety net system, personal fall arrest system or any alternate fall protection.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend to at least 3 feet (.9m) above the upper landing surface to which the ladder was used to gain access nor was the ladder secured at it's top to a ridgid support and a grasping device, such as a grabrail, provided to assist the employee in mounting and dismounting the the ladder:    a. On or about October 24, 2013, an employee used a wooden ladder to access a roof improperly, in that the ladder did not extend 3 feet over the eave nor was secured from slippage, exposing the employee to a fall hazard.
