29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: Location: 1140 South Rock Hill Road, Webster Groves, MO 63119 Workers were observed on top of an approximate 12:12 pitch roof, approximately 9-12 feet above ground, using alternative fall protection, and were not protected by guardrail systems, safety net system, or personal fall arrest system. The workers were using toeboards/slide guards as the sole means of fall protection. Fitzgerald Roofing Company was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 900022, citation number 1, item number 1, and was affirmed as a final order on 05/1/2013, with respect to a workplace located at 2010 Urban Drive, Brentwood, MO 63144.
