29 CFR 1910.178(a)(4): Modifications and additions which affect capacity and safe operation shall not be performed by the customer or user without manufacturers prior written approval. Capacity, operation, and maintenance instruction plates, tags, or decals shall be changed accordingly.    a.     At  Building 5 where employees were using a Sky Trak rough terrain forklift to lift trusses into place without written permission from the manufacturer modiyfing the the powered industrial truck exposes the employees to a struck-by hazard.

29 CFR 1926.404(f)(6): Grounding path. The path to ground from circuits, equipment, and enclosures shall be permanent and continuous.    a. On Building 5 where an extension cord was used to provide power to portable tools, the ground prong was missing thereby exposing employees to a contact hazard.

29 CFR 1926.405(a)(2)(ii)(I): Flexible cords and cables shall be protected from damage. Sharp corners and projections shall be avoided. Flexible cords and cables may pass through doorways or other pinch points, if protection is provided to avoid damage.    a.     At the front of Building 10, there was a extension cord which ran across the dirt road and was exposed to damage from vehicle traffic to provide power to the framers on the roof thereby exposing employees to a contact hazard.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.  Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fall protection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complies with 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems.    a.     On the roof of building 5 where the employees were framing the roof deck, employees of Alderete Construction were not  wearing fall protection thereby exposing employees to a fall hazard.

29 CFR 1926.1052(c)(1): Stairways having four or more risers or rising more than 30 inches (76 cm), whichever is less, shall be equipped with:    29 CFR 1926.1052(c)(1)(i): At least one handrail;     a.     At Building 5 where employees used the stairways to gain access to the second floor and then onto the roof to perform framing, there were no handrails thereby exposing employees to a trip/fall hazard.
