29 CFR 1926.95(a): Personal protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, was not provided, used, or maintained in a sanitary and reliable condition it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation, or physical contact.    At the side of the Finance Factors building on November 4, 2013, safety shoes were not used while erecting a two tier frame type scaffold.  Employees were exposed to scaffold components and tools falling onto their feet.

29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:    At the side of the Finance Factors building on November 4, 2013, hard hats were not used when employees were working below a two tier frame scaffold that was being erected.  Employees were exposed to head injuries from falling scaffold components and tools.

29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, sturcure, personnel hoist, or similar surface was not used.  Crossbraces were used as a means of access.  At the side of the Finance Factors building on November 4, 2013, a portable ladder or other acceptable means of access were not provided to access the frame scaffold.  Employees accessed the working platform using the built in ladder on the scaffold end frame.  The distance from the bottom rung to the ground was about 26 3/4 inches.

29 CFR 1926.451(g)(2): The employer did not have a competent person determine the feasibility and safety of providing fall protection for employees erecting or dismantling supported scaffolds:  At the side of the Finance Factors building on November 4, 2013, the employer failed to have a  competent person on site to determine the feasibility and safety of providing fall protection for employees erecting a two tier frame type scaffold. Employee was exposed to a fall hazard of about 11 feet, 10 inches.
