29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: (Construction Reference: 1926.59)  a) On or about November 5, 2013, at the VA Medical Center, Bldg 160, Mountain Home, TN, employees were exposed to various hazardous materials (to include but not limited to various paints, mineral spirits, skrete, sheetrock joint compound, PVC primer and cement) and did not have immediate access to the written hazard communication program.  Without proper information on hazardous materials, employees could mis-handle materials and expose themselves to allergic reactions, and various irritations both internal and external.  In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1910.1200(e)(2): The employer that produced, used, or stored hazardous chemicals at the workplace in such a way that employees of other employer(s) could be exposed did not ensure that the hazard communication program included all of the elements outlined in 29 CFR 1910.1200(e)(2)(i) through 29 CFR 1910.1200(e)(2)(iii): (Construction Reference: 1926.59)  (a) On or about November 5, 2013, at the VA Medical Center, Bldg 160, Mountain Home, TN, employees were exposed to various hazardous materials under the control of multiple employers and Valiant Construction's Hazard Communication Program did not address the regulatory requirements for multi-employer worksites. Without proper information on hazardous materials employees could mis-handle hazardous materials and expose themselves to bodily injury, and/or disease, alergic reations, and various irritations both internal and external.  In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1910.1200(g)(8): The employer did not maintain copies of the required material safety data sheets for each hazardous chemical in the workplace: (Construction Reference: 1926.59).  a) On or about November 5, 2013, at the VA Medical Center, Bldg 160, Mountain Home, TN, Valiant Construction employees were exposed to various hazardous materials (included but not limited to various paints, mineral spirits, skrete, sheetrock joint compound, PVC primer and cement) and did not have immediate access to Material Safety Data Sheets for hazardous materials used by employees.  Without proper information on hazardous materials employees could mis-handle hazardous materials and expose themselves to bodily injury, and/or disease, alergic reations, and various irritations both internal and external.
