29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees: a) On or about November 6, 2013 at the corner of State Street and South Ferry Street in Schenectady, New York 12305, an employee was exposed to a caught between hazard while shoveling to expose utilities at a depth that was approximately 7 feet below grade. He was not provided with a safe means of egress from this trench.

29 CFR 1926.651(k)(1): An inspection of the excavations, the adjacent areas, and protective systems was not conducted by the competent person prior to the start of work and as needed throughout the shift: a) On or about November 6, 2013 at the corner of State and South Ferry Street an employee in a trench greater than 5 feet deep without an adequate protection system was exposed to a possible trench cave-in and caught between hazard while in plain sight of the person that later identified himself as the competent person on the jobsite. The employee was working shoveling to expose utilities at approximately 7 feet deep below grade.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c). a) On or about November 6, 2013 at the corner of State and South Ferry Street, Schenectady, NY 12305 an employee in a trench greater than 5 feet deep without an adequate protective system was exposed to a possible trench cave-in. The employee was working at a depth of approximately 7 feet below grade hand digging to expose utilities. The trench was not adequately sloped, shored or otherwise protected from collapse.
