There was a ladder on site but it was along the sloped top half of the excavation and not in the bottom where employees were working.

29 CFR �1926.652 (a) (1): Each employee in an excavation shall be protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section:  a) 815 Trottingham Dr. - On or about September 22, 2018 and at times prior thereto, employees were working in a 26' deep excavation with the top half sloped and the bottom having a trench box as protection. The sloping system on the  top  half of the excavation was not designed in accordance with any option in 29 CFR  �1926.652 (b) and no other protective system was utilized in this section of the trench. The bottom half of the excavation was not  sloped and the trench box that was utilized in this section of  the  trench did not  comply with any option in 29 CFR �1926.652 (c) in that the top of the trench box was not level or above the top of the trench.   On September 22, 2018 employees from TKC, along with employees from the Town of Niskayuna, performed work to repair a sewer force main break under Trottingham Drive, near house number 815.
