29 CFR 1926.501(b)(11): Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels was not protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems: a) On or about 11/07/13, on residential jobsite located at 293 Colvin Ave., Buffalo, NY: Employees engaged in roofing work on a steep roof were exposed to a fall of approx. 22 foot because no adequate fall protection system was utilized. The roof pitch was estimated to be approx. 6 in 12. A row of slide guards had been installed as fall protection in some areas, but this did not comply with OSHA fall protection requirements. NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.451(g)(1)(i): Each employee on a boatswains' chair, catenary scaffold, float scaffold, needle beam scaffold, or ladder jack scaffold was not protected by a personal fall arrest system: a) On or about 11/07/13, on residential jobsite located at 293 Colvin Ave., Buffalo, NY: Employees walking & working from a narrow 14 in. wide aluminum "pic" of a ladder jack scaffold erected on the south side of the house were exposed to a fall of approx. 20 ft. to the ground. No personal fall arrest system or other fall protection system was utilized. NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: a) On or about 11/07/13, on residential jobsite located at 293 Colvin Ave., Buffalo, NY: Employees engaged in roofing work were exposed to a potential fall of approx. 20 ft. to the ground when an extension ladder was used to access the narrow "pic" of a ladder jack scaffold erected on the south side of the building. The siderails of the extension ladder only extended 26 inches above "pic". b) On or about 11/07/13, on residential jobsite located at 293 Colvin Ave., Buffalo, NY: Employees engaged in roofing work were exposed to a potential fall of up to 22 ft. to the ground when they climbed the west ladder jack scaffold support ladder from the "pic" of the scaffold to access the roof. The siderails of that support ladder were approx. 16 inches above the gutter. NO ABATEMENT CERTIFICATION REQUIRED
