29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used:  a) On or about 10/28/19, at a 2-story house located at 377 Linden Ave., Buffalo, NY: A ladder jack scaffold consisting of 2 aluminum piks, an extension ladder from the ground at each end with the pik resting solely on the top rung of those ladders, and two support ladders in between on the porch roof with support brackets that were on the outside of the ladders, with weight distributed on multiple rungs. In order to access and exit the piks, employees had to climb over the brackets. No separate access ladder was provided.     NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.452(k)(5): Scaffold platforms were bridged on to another.  a) On or about 10/28/19, at a 2-story house located at 377 Linden Ave., Buffalo, NY:  A ladder jack scaffold consisting of 2 aluminum piks, an extension ladder from the ground at each end with a pik resting solely on the top rung of those ladders, and two support ladders in between on the porch roof with support brackets that were on the outside of the ladders, with weight distributed on multiple rungs. The pik on the east end of the scaffold overlapped (bridged) the pik on the west end of the scaffold by about 5 ft. at the east bracket support ladder.   NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a) On or about 10/28/19, at a 2-story house located at 377 Linden Ave., Buffalo, NY: Two employees engaged in sheeting work on the front upper left steep roof were exposed to a fall of approx. 10 ft. to the floor of the balcony below because no fall protection system was utilized. One employee was wearing a full body harness with a lanyard attached to the harness, but the lanyard was not tethered to an anchor. The other employee was wearing a full body harness, but no lanyard was attached to the harness.    b) On or about 10/28/19, at a 2-story house located at 377 Linden Ave., Buffalo, NY: One employee was on the flat porch roof on the front right side of the house supplying materials such as plywood sheeting to employees working on the ladder jack scaffolding above him. The employee was not wearing a harness and was exposed to a fall of approx. 13 ft. to the ground.   NO ABATEMENT CERTIFICATION REQUIRED
