29 CFR 1926.20(b)(2): The employer failed to initiate and maintain programs that provided for frequent and regular inspections of the job sites, materials, and equipment were made by competent persons designated by the employer:   At the project on or about November 12, 2013, and at times prior thereto, inspections were not completed to ensure compliance with OSHA regulations or the person that completed the inspections was not competent as there were hundreds of unguarded rebars onsite, no toilets onsite, and no adequate washing facilities onsite.

29 CFR 1926.51(c)(1): Toilets were not provided for employees:   At the project on or about November 12, 2013, and at times prior thereto, there were no toilets onsite.  Employees did not travel from site to site during the day.  They stayed onsite for the duration of the work shift.  Employees said they were not allowed to use the toilet at the house next door and needed to relieve themselves outside.

29 CFR 1926.51(f)(1): The employer did not provide adequate washing facilities for employees engaged in the application of paints, coating, herbicides, or insecticides, or in other operations where contaminants may be harmful to the employees. Such facilities were not in near proximity to the worksite and were not so equipped as to enable employees to remove such substances:   At the project on or about November 12, 2013, soap was not provided or available onsite and towels or other drying methods were not provided.  Employees had cement residue on their fingers and hands.  Employees mixed portland cement with water and used the cement to lay concrete masonry units.  Employees were not allowed to use the neighbors restrooms and remained onsite during the entire work shift.

29 CFR 1926.405(a)(2)(ii)(I): Flexible cords and cables shall be protected from damage:   In the driveway to the project on or about November 12, 2013, a 110 VAC extension cord was not protected from damage as it lay on the compacted gravel and was run over by vehicles.  The cord was plugged into a receptacle on the exterior of the house next door.  An indentation was clearly visible in the gravel driveway where the cord laid.

29 CFR 1926.701(b): Reinforcing steel. All protruding reinforcing steel, onto and into which employees could fall, was not guarded to eliminate the hazard of impalement:   At the project on or about November 12, 2013, hundreds of rebars were not guarded against impalement.  The 3/8s inch diameter rebars protruded vertically about 26 to 40 inches from ground level.  The rebars protruded from concrete masonry units on the perimeter of the houses.  Some rebars onsite were capped.
