29 CFR 1926.404(f)(6): The path to ground from circuits, equipment, or enclosures was not permanent and continuous:  On or about November 08, 2013, and at times prior thereto, the employer did not ensure that the path to ground was maintained in two instances on the job site, exposing employee to electrical hazards.  a. On the Makita Model 5007F Circular Saw the ground prong was missing on the power cord.  b. On the Porter Cable Model PC18JR Jobsite Radio the ground prong was missing on the power cord.

29 CFR 1926.416(e)(1): Worn or frayed electric cords or cables were used:  On or about November 08, 2013, and at times prior thereto, the employer did not ensure that worn and frayed electrical cords were not used in two instances, exposing employees to the hazard of electrical shock.    a. On the Makita Model 5007F Circular Saw the power cord was worn and the inner insulation was visible.  b. On the Orange 5 foot extension cord the cord was worn and cracked and the inner insulation was visible.

29 CFR 1926.451(c)(2)(iii): Unstable objects were used as working platforms:  On or about November 08, 2013, and at times prior thereto, employees working from the Metaltech 2 tier scaffolding were standing on unstable objects. The employee working on the scaffolding had one foot on the scaffolding mid-rail and one foot on a cross member frame support of the building, exposing the employee to a fall hazard of approximately 10 feet.

29 CFR 1926.452(w)(2): Scaffold casters and wheels were not locked with positive wheel and/or wheel and swivel locks, or equivalent means, to prevent movement of the scaffold while the scaffold was used in a stationary manner:   On or about November 08, 2013, and at times prior thereto, the employer did not ensure that the caster and wheels on the 2 tier Metaltech metal frame scaffolding were locked to prevent movement of the scaffolding system exposing the employee to a fall hazard of approximately 8 feet.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.  On or about November 08, 2013, and at times prior thereto, the employer did not ensure that an employee performing framing work was protected from falling out of the framed wall, exposing the employee to fall hazard to approximately 11 feet. The employee was leaning out of the framed wall while taking measurements.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  On or about November 08, 2013, and at times prior thereto, employees working on the commercial property under renovation had not received training on the use of fall protection prior to being allowed to work on the roof, exposing the employees to fall hazard of up to 11 feet.
