29 CFR 1926.301(c): Impact tools, such as drift pins, wedges, and chisels, were not kept free of mushroomed heads: In the garage on or about November 18, 2013, an 11.5 inch long chisel was not kept free of a mushroomed head. A hammer was used to hit the chisel, used to rough up the concrete floor for tile grout.

29 CFR 1926.403(i)(2)(i): Except as required or permitted elsewhere in this subpart, live parts of electric equipment operating at 50 volts or more was not guarded against accidental contact by cabinets or other forms of enclosures, or by any of the following means: In the kitchen and next to the utility room on or about November 18, 2013, 110 VAC three way switches were not inside the electrical boxes and the exposed terminals were energized. The bottom of the switch boxes were about 44 inches above the floor.

29 CFR 1926.404(b)(1)(i): The employer did not use either ground fault circuit interrupters as specified in paragraph (b)(1)(ii) of this section or an assured equipment grounding conductor program as specified in paragraph (b)(1)(iii) of this section to protect employees on construction sites. These requirements are in addition to any other requirements for equipment grounding conductors: In the garage on or about November 18, 2013, there was no assured equipment grounding conductor program or ground fault circuit interrupter protection for employees that used a 110 VAC Makita drill to mix grout and a 110 VAC Makita angle grinder to cut tile. The tools were powered through extension cords.
