29 CFR 1926.20(b)(2):  The employer did not develop an accident prevention program, that provided for frequent and regular inspections of the job sites, materials, and equipment, to be made by competent persons designated by the employer:    (a) Eastbound Side of Bridge - The job site did not have a competent person in that the person in charge did not have an understanding of the correct use of the components of personal fall arrest systems evidenced as follows:  employees used a self-retracting lifeline as a horizontal lifeline; employees did not use the leg straps of their harnesses; and employees used shock absorbing lanyards in-line with self-retracting lifelines; all of which could cause the personal fall arrest systems to fail exposing employees to a fall to a lower level or to contacting a lower level in the event of a fall, on or about November 20, 2013.    Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.

29 CFR 1926.95(a): Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, was not provided, used, and maintained in a sanitary and reliable condition wherever it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact:    (a) Eastbound Side of Bridge - Employees worked constructing the bridge, which had a height of 16 feet 5.5 inches above the creek below.  The employees used personal fall arrest systems for fall protection; however, at least three of the employees did not wear the leg straps of their harnesses.  The harnesses would not work reliably in the event of a fall in that, without the leg straps, the wearer would fall out of the harness, on or about November 20, 2013.    Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.

29 CFR 1926.502(d)(8): Horizontal lifelines were not designed, installed, and used under the supervision of a qualified person, as part of a complete personal fall arrest system, which maintained a safety factor of at least two:    (a) Eastbound Side of Bridge - Employees worked constructing the bridge, which had a height of 16 feet 5.5 inches above the creek below.  The employees used a Protecta Rebel self-retracting lifeline (SRL) as a horizontal lifeline, which ran perpendicular to two stanchion post horizontal lifelines.  The employees attached the housing connector of the SRL to a stanchion post of the stanchion post horizontal lifeline running along the north side of the bridge and attached the snaphook end of the SRL to a stanchion post of a second stanchion post horizontal lifeline running down the middle of the bridge.  Protecta designed the SRL for use as a deceleration device and did not design the SRL for use as a horizontal lifeline.  The use of the SRL as a horizontal lifeline exposed employees to a fall to a lower level, on or about November 20, 2013.    Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.

29 CFR 1926.502(d)(16)(iii): Personal fall arrest systems, when stopping a fall, were not rigged such that an employee could not free fall more than 6 feet (1.8 m) nor contact any lower level:    (a) Eastbound Side of Bridge - Employees worked constructing the bridge, which had a height of 16 feet 5.5 inches above the creek below.  At least three employees used 6-foot long shock absorbing lanyards attached to self-retracting lifelines as part of their personal fall arrest systems.  The use of two deceleration devices in-line would increase the employees' free fall distance to greater than 6 feet, on or about November 20, 2013.    Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.
