Circumstances where retraining is required include, but are not limited to, situations where: 29 CFR 1926.503(c)(3): Inadequacies in an affected employee's knowledge or use of fall protection systems or equipment indicate that the employee has not retained the requisite understanding or skill. a) At the worksite, the employer did not ensure that employees, working from the roof area performing framing task, were clear on the requirements for fall protection use.

29 CFR 1926.102(a)(1): Employees shall be provided with eye and face protection equipment when machines or operations present potential eye or face injury from physical, chemical, or radiation agents. a) On or about December 05, 2013, on the site, the employer did not ensure employees using a nail gun were provided with and utilized eye protection, thereby exposing employees to a potential struck-by hazard. JD Duran Construction, Inc. was previously cited for a violation of this Occupational Safety and Health Standard or its Equivalent Standard 29 CFR 1926.102(a)(1), which was contained in OSHA Inspection Number 313153512, Citation Number 1, Item Number 1 and was affirmed as a final order on March 05, 2010, with respect to a workplace located at Dogwood Apartment Complex, Morse Road, Columbus, Oh 43253.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. a) On or about December 05, 2013, at the worksite located at 5483-5489 Warner Way in Westerville, Oh, the employer did not ensure/enforce that employees utilize fall protection while performing framing activites such as, but not limited to erecting walls and sheathing the roof on a two story apartment complex building, thereby exposing employees to an approximate 16 foot fall hazard. J.D.Duran, Inc. was previously cited Repeat (twice) for a violation of this Occupational Safety and Health Standard or its Equivalent Standard 29 CFR 1926.501(b)(13), which was contained in OSHA Inspection Number 314586785, Citation Number 1, Item Number 1 and was affirmed as a final order on April 04, 2011, with respect to a workplace located at 325 Hutenson Avenue, Columbus, Oh 43235.
