1926.503(a)(1): "Training Program." The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards. Employer did not provide a training program for employees that were observed performing framing work on a second story floor area while not utilizing a fall protection system and exposed to potential fall heights in excess of 14 feet.

29 CFR 1926.501(b)(1): "Unprotected sides and edges". Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. Located on the north side of a residential structure, an employee was exposed to a fall hazard while performing wall erection at the unprotected edge of a second story floor area while not utilizing a fall protection system. Potential fall height was measured to be greater than 14 feet above the hard ground below. J. D. Duran Construction, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 955305, citation number 1, item number 2 and was affirmed as a final order on 4/02/2014, with respect to a workplace located at 5363-5389 Amity Moor Road, Building #10 & Garage, Westerville OH 43081. J. D. Duran Construction, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 951117, citation number 2, item number 2 and was affirmed as a final order on 2/11/2014, with respect to a workplace located at 5483-5489 Warner Way, Westerville OH 43081. J. D.
