29 CFR 1910.178(l)(1)(i): The employer did not ensure each powered industrial truck operator was competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l). At the worksite: On or about December 3, 2013, and at times prior thereto, the employer allowed an employee to operate a rough terrain type forklift without providing the required training and evaluation for powered industrial trucks. Employees were exposed to fall from heights, caught in between and struck-by hazards.

29 CFR 1926.602(c)(1)(viii): Whenever a truck is equipped with vertical only, or vertical and horizontal controls elevatable with the lifting carriage or forks for lifting personnel, the following additional precautions shall be taken for the protection of personnel being elevated: (A) Use of a safety platform firmly secured to the lifting carriage and/or forks. (B) Means shall be provided whereby personnel on the platform can shut off power to the truck. (C) Such protection from falling objects as indicated necessary by the operating conditions shall be provided. At the worksite: On or about December 3, 2013, the employer allowed employees to use a rough terrain forklift to support an elevated work platform without a means to shut off power to the truck. Employees were exposed to the fall, struck-by, and caught in between hazards.
