29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: (a) Birdsboro Kosher Farms Corporation - Kill Room - The employer did not develop or implement a Hearing Conservation Program for the employees exposed to a Time Weighted Average of 108.7 dBA. This employee exposure was equivalent to a dose of 1670.2 %. The employee exposure was derived from the 610 minutes sampled on December 17, 2013. (b) Birdsboro Kosher Farms Corporation - Kill Room - The employer did not develop or implement a Hearing Conservation Program for the employees exposed to a Time Weighted Average of 107.5 dBA. This employee exposure was equivalent to a dose of 1421.3 %. The employee exposure was derived from the 610 minutes sampled on December 17, 2013. MVP Kosher Foods LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard (29 CFR 1910.95(c)(1)), which was contained in OSHA inspection number 315888503, citation number 1, item number 1 and was affirmed as a final order on (10/10/2013), with respect to the workplace located at 1100 Lincoln Road, Birdsboro, PA 19508. The original citation was amended in the formal settlement agreement with the company to include Birdsboro Kosher Farms in the amended citation. Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.
