29 CFR 1910.23(e)(1): A standard railing did not consist of top rail, intermediate rail, and posts, and have a vertical height of 42 inches nominal from upper surface of top rail to floor, platform, runway, or ramp level. The intermediate rail was not approximately halfway between the top rail and the floor, platform, runway, or ramp. The railing surrounding the pit on the Barner Slitting machine had a top rail which was 48 inches in height and an intermediate railing which was 28 inches in height.

29 CFR 1910.212(b): Anchoring fixed machinery. Machines designed for a fixed location were not securely anchored to prevent walking or moving. On 12/16/2013, MiTek USA Inc. had not securely anchored a several machines. The following machines were not anchored to the floor in the tool room: Bridgeport Milling Machines #1, #2, & #4; Burgmaster Drill Press; and a Brown & Sharpe 618 Micromaster Surface Grinding Machine.
