29 CFR 1910.178(l)(4)(ii)(B): Refresher training, including an evaluation of the effectiveness of that training, was not provided to the operator when the operator has been involved in an accident or near-miss incident: (a) The employer did not enforce and provide refresher training to a powered industrial vehicle operator when he was involved in a near-miss incident with the Hyundai #440 maintenance fork truck in the Small Meter Plant on or about December 19, 2013.

(a) On or about December 19, 2013 in the Small Meter Plant, a powered industrial vehicle operator did not yield the right of way to a pedestrian crossing an aisle and cease fork truck operations until safe passage was completed, resulting in a near-miss incident.
