29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph (b) of this section:    Employees installing floor joists from the top of block walls are not protected from fall hazards by a fall protection system.    The employer fails to assure effective protection against falls as required by the standard, as demonstrated on January 7, 2014, when employees were installing floor joists from the top of the block walls at 16212 Bayberry Dr., Lithia, FL 33547 without fall protection and were exposed to a fall hazard of approximately 9 feet, 10 inches to 10 feet, 2 inches.   Burgos Construction Corp. previously committed a repeat violation of this standard on June 26, 2013 with respect to a workplace at 9209 European Olive, Riverview, FL, which became a final order on August 26, 2013 (Inspection No. 914352).    Burgos Construction Corp. previously committed a serious violation of this standard on June 4, 2013 with respect to a workplace at 10523 & 10521 White Peacock, Riverview, FL, which became a final order on August 5, 2013 (Inspection No. 909994).    Burgos Construction Corp. previously committed a serious violation of this standard on June 4, 2013 with respect to a workplace at 15932 Courtside View, Lithia, FL, which became a final order on August 19, 2013 (Inspection No. 910183).   Burgos Construction Corp. previously committed a serious violation of this standard on May 2, 2013 with respect to a workplace at 9222 Mountain Magnolia, Riverview, FL, which became a final order on June 11, 2013 (Inspection No. 903877).          Burgos Construction Corp. previously committed a serious violation of this standard on March 29, 2013, 2013 with respect to a workplace at The Manors at Trinity Preserve, Trinity, FL, which became a final order on June 3, 2013 (Inspection No. 898691).    To abate this violation, the employer must ensure that its employees installing floor joists are protected from falls, and that no employee is allowed onto a block wall 6 feet or more in height without adequate fall protection.  Pursuant to 29 C.F.R. 1903.19, the employer must submit documents describing the steps it is taking to ensure compliance, including a description of how these steps protect its employees from fall hazards.

29 CFR 1926.1053(b)(4): Ladder(s) were used for purposes other than the purpose for which they were designed:  An employee installing floor joists while standing on the top of a folded step ladder propped against the wall was not protected from fall hazards by the proper use of a ladder.  The employer fails to assure effective protection against falls as required by the standard, as demonstrated on January 7, 2014, when an employee was installing floor joists at 16212 Bayberry Dr., Lithia, FL 33547 while using a ladder improperly and was exposed to a fall hazard of approximately 5 feet, 8 inches.  Burgos Construction Corp. previously committed a serious violation of this standard on May 2, 2013 with respect to a workplace at 9222 Mountain Magnolia, Riverview, FL, which became a final order on June 11, 2013 (Inspection No. 903877).    Burgos Construction Corp. previously committed a serious violation of this standard on March 29, 2013 with respect to a workplace at The Manors at Trinity Preserve, Trinity, FL 34655, which became a final order on June 3, 2013 (Inspection No. 898691).   To abate this violation, the employer must ensure that its employees using ladders are protected from falls, and that no employee is allowed to use a ladder in a manner for which it was not designed.  Pursuant to 29 C.F.R. 1903.19, the employer must submit documents describing the steps it is taking to ensure compliance, including a description of how these steps protect its employees from fall hazards.
