29 CFR 1926.1052(c)(1): Stairways having four or more risers or rising more than 30 inches (76 cm), whichever is less, were not equipped with at least one handrail and one stairrail system along each unprotected side or edge:  New construction of a 2 story-residential home located at 10229 Summer Azure Dr. Riverview, FL  (a) Employees were accessing the second floor via an 18 riser stairwell that was not protected by a handrail on both sides, on or about 01/27/14.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph (b) of this section:  Employees performing carpentry/decking work on a roof 6 feet or more above ground and employees working on an unprotected floor on the second level of the house are not protected from fall hazards by a fall protection system.    The employer fails to assure effective protection against falls as required by the standard, as demonstrated on January 27, 2014, when employees were working on a residential roof at 10229 Summer Azure Dr., Riverview, FL 33569 without fall protection and were exposed to a fall hazard of approximately 9 feet, 4 inches and employees were working on an unprotected floor and were exposed to a fall hazard of approximately 10 feet, 10 inches.  Burgos Construction Corp. previously committed a repeat violation of this standard on June 26, 2013 with respect to a workplace at 9209 European Olive, Riverview, FL, which became a final order on August 26, 2013 (Inspection No. 914352).    Burgos Construction Corp. previously committed a serious violation of this standard on June 4, 2013 with respect to a workplace at 10523 & 10521 White Peacock, Riverview, FL, which became a final order on August 5, 2013 (Inspection No. 909994).    Burgos Construction Corp. previously committed a serious violation of this standard on June 4, 2013 with respect to a workplace at 15932 Courtside View, Lithia, FL, which became a final order on August 19, 2013 (Inspection No. 910183).   Burgos Construction Corp. previously committed a serious violation of this standard on May 2, 2013 with respect to a workplace at 9222 Mountain Magnolia, Riverview, FL, which became a final order on June 11, 2013 (Inspection No. 903877).          Burgos Construction Corp. previously committed a serious violation of this standard on March 29, 2013 with respect to a workplace at The Manors at Trinity Preserve, Trinity, FL, which became a final order on June 3, 2013 (Inspection No. 898691).  To abate this violation, the employer must ensure that its employees performing roofing work and work on floors being constructed are protected from falls, and that no employee is allowed onto a roof or a floor under construction that are 6 feet or more in height without adequate fall protection.  Pursuant to 29 C.F.R. 1903.19, the employer must submit documents describing the steps it is taking to ensure compliance, including a description of how these steps protect its employees from fall hazards.
