OSH ACT of 1970 Section (5)(a)(1):      The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees are exposed to crushing hazards as a result of possible hoist failure.        At the following locations, the employer failed to ensure that the hoists were inspected in a manner that met the requirements outlined in ANSI B30.16.       a) West Side Battery Area; Coffing 2-ton hoist      b)  Maintenance Shop;  Coffing 1-ton hoist      c)  Engine Room; Unknown hoist.

29 CFR 1910.119(d)(3)(ii):     The employer did not document that equipment complies with recognized and generally accepted good engineering practices.    Worksite located at 10711 Olive Street, La Vista, NE; the following condition exist which violate recognized and generally accepted good engineering practices:     a.  Rooftop mounted discharge header near the Engine Room:  The ammonia relief system header discharge piping is located 57 above the roof surface. ASHRAE 15-2004, Section 9.7.8 states that pressure relief discharges are to be directed 15 feet above the ground, 20 feet from a window, ventilation or building entry.  In this instance, due to the fact that maintenance personnel work on the roof that is considered the working surface and the relief discharge should be 15 feet above the roof.      Abatement certification is required for this violation. The abatement certification sheet is enclosed for the citations.

29 CFR 1910.147(c)(4)(ii):     The energy control procedures did not clearly and specifically outline the scope, purpose, authorization, rules, and techniques to be utilized for the control of hazardous energy, including, but not limited to the items of this section:     Worksite located at 10711 Olive Street, La Vista, NE and Throughout the facility:  Lockout/tag out procedures did not meet the requirements outlined above.  Some of the developed procedures are vague in that they do not clearly specify the techniques in which lockout operations will be performed and they do not clearly indicate the locations where energy may be isolated (switches, valves, breaker numbers, etc).        Abatement certification is required for this violation.  The abatement certification sheet is enclosed with the citations.

29 CFR 1910.147(c)(6)(i):     The employer did not conduct a periodic inspection of the energy control procedure at least annually to ensure that the procedure and the requirement of this standard were being followed:    Worksite located at 10711 Olive Street, La Vista, NE and Throughout the facility:  The employer failed to conduct a periodic inspection of the energy control procedures as outlined in the standard.  Each specific procedure is to be reviewed by two authorized employees on an annual basis.  The employer only reviewed a portion of the procedures (one).        Abatement certification is required for this violation.  The abatement certification sheet is enclosed with the citations.

29 CFR 1910.178(n)(8):    The employer failed to ensure that under all travel conditions powered industrial trucks were operated at a speed that will permit it to be brought to a stop in a safe manner.      Worksite located at 11711 Olive Street, La Vista, NE:  The employer failed to ensure that powered industrial truck operators operated the vehicles at a safe speed.  The trucks were seen moving throughout he loading dock area at high rates of speed which caused a number of observed near-miss situations which were observed by the compliance officer.        This item was abated during the inspection by adjusting the speed governor on the fork trucks to a lower speed.
