29 CFR 1917.26(f): A US Coast Guard approved 30 inch life ring, with at least 90 feet of line attached, was not available at readily accessible points at each waterside work area where the employees work exposed them to the hazard of drowning. On or about the period of January 9, 2014, through January 14, 2014, County Material employees worked on the apron adjacent to the barge slip without a life ring and line. There is no abatement certification or documentation required for this item.

The ladder had a missing top rung and defective side rails that were not repaired. Abatement certification is required for this item in accordance with the requirements of 29 CFR 1903.19(c).

29 CFR 1918.26(b): When a ramp or walkway could not be used, the employer did not provide a straight ladder meeting the requirements of 29 CFR 1918.24 and extending at least 3 feet (.91 m) above the upper landing surface and adequately secured or held against shifting or slipping. NOTE: For barges operating on the Mississippi River System, where the employer shows that these requirements cannot reasonably be met due to local conditions, other safe means of access shall be provided. On or about the period of January 23, 2014, County Material employees accessed barges by way of a portable straight ladder that was not secured against shifting or slipping. Abatement certification is required for this tem in accordance with the requirements of 29 CFR 1903.19(c).
