29 CFR 1926.100(a): Employees were not protected by protective helmets while working in areas where there was a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns.       On or about January 16, 2014, the employer did not ensure personal protective equipment, such as hard hats were being worn by employees while working underneath other employees on higher levels of the tubular welded frame scaffold.  Employees were exposed to struck by hazards.

29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents.   On or about January 16, 2014, the employer did not ensure employees performing masonry activities such as cutting brick with a Stihl saw were wearing eye and face protection exposing employees to struck-by hazards and eye injuries.

29 CFR 1926.451(b)(1): Each platform on all working levels of scaffolds was not fully planked or decked between the front uprights and the guardrail supports as specified in paragraphs 1926.451(b)(1)(i)-(ii).      On or about January 16, 2014, the employer did not ensure that all levels of the tubular welded frame scaffold were fully decked, exposing employees to fall hazards:    a)  East side scaffold, employees working from the 2nd tier.  b)  South side scaffold, employees working from the 3rd tier.

29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used.  Crossbraces were used as a means of access.   On or about January 16, 2014,  the employer did not ensure a ladder was provided for employees to gain access or to have a means of exiting from the scaffold, exposing employees to fall hazards:  a)  East side tubular welded frame scaffold, employees working on the 2nd tier. b)  South side tubular welded frame scaffold, employees working on the 3rd tier.

29 CFR 1926.451(g)(1): Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section.   On or about January 16, 2014,  the employer did not ensure guardrails were installed on the tubular welded frame scaffold located on the south side of the building, exposing employees to fall hazards of 19 feet.
