29 CFR 1910.134(c): The employer did not develop and/or implement a written respiratory protection program with required worksite-specific procedures and elements for required respirator use: a. Underneath LCU 1635, Marine Railway 4 - On or about 1/30/14, and at times prior thereto, where the employer required the use of respirators, the employer failed to implement the applicable section of the respiratory protection program in that an employee stored a half mask respirator in an area exposed to chemicals. b. Underneath LCU 1635, Marine Railway 4 - On or about 1/30/14, and at times prior thereto, where the employer required the use of respirators, the employer failed to implement the applicable section of the respiratory protection program in that a half mask respirator was worn by an employee who had facial hair that came between the sealing surface of the facepiece and the face.
