29 CFR 1926.100(a): Employees were not protected by protective helmets while working in areas where there was a possible danger of head injury from impact, or from falling objects:  a) 1001 South 17th Street, Philadelphia, PA - An employee was working in an excavation, approximately 70 feet long by 70 feet wide and 10 feet deep, and was not wearing head protection, thus exposing the employee to the danger of head injuries. This violation was observed on or about January 17, 2013.  Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.

29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees:  a) 1001 South 17th Street, Philadelphia, PA - The employees were working in an excavation approximately 70 feet long by 70 feet wide and 10 feet deep without having a means of egress from the excavation, thus exposing the employees to trip/falls/cave-in hazards. This violation was observed on or about January 17, 2013.  Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. This condition exposed the employees to struck-by hazards. This violation was observed on or about January 17, 2013. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Protection by placing and keeping such materials or equipment at least 2 feet from the edge of excavations, or by the use of retaining devices that are sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary was not provided:  a) 1001 South 17th Street, Philadelphia, PA - The employees were working in an excavation approximately 70 feet long by 70 feet wide and 10 feet deep in which the spoil pile and the Hitachi EX150 excavator was not placed or kept at least 2 feet from the entrance of the excavation nor were any retaining devices used. This condition exposed the employees to cave-in/struck-by hazards. This violation was observed on or about January 17, 2013.  Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement.
