29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program, as described in paragraphs (c) through (o) whenever employee noise exposures equal or exceeded an 8-hour time-weighted average sound level (TWA) of 85 decibels measured on the A scale (slow response) or, equivalently, a dose of fifty percent.     This violation was discovered on or about February 5, 2014, where the employer does not administer a hearing conservation program for employees working in the shipping and crating areas who are exposed to noise levels that exceed an 8-hour TWA of 85dBA.

29 CFR 1910.1200(e)(1): Employer did not develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, material safety data sheets, and employee information and training would be met.    This violation was discovered on or about February 5, 2014, where the employer does not develop, implement, and maintain a written hazard communication program for employees working in the warehouse and painting department when working with chemicals such as, Methyl Ethyl Ketone, and paint containing: Methyl Isobutyl Ketone, Hexamethylene Diisocyanate, Hexamethylene Diisocyanate Polymer, 1-Butanol, Ethylbenzene, n-Butyl Acetate, and t-Butyl Acetate.
