OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that forklift were operated without the use of seatbelts, exposing employees to ejection and struck-by hazards: a) LULL 644B-37, Highlander Forklift S/N 97V12N21-763 - On or about and at times prior times to February 25, 2014, an employee was operating the forklift without the use of seatbelts and other defects that affected the safe operation of the forklift, exposing the employee to ejection, and others to struck-by and crushing hazards. The following additional defects were observed: 1. Seatbelt not functional 2. Load chart not available 3. Angle Indicator 4. Rear solid rubber tires severely worn ABATEMENT CERTIFICATION IS REQUIRED
