29 CFR 1926.501(b)(2)(i): Each employee who was constructing a leading edge 6 feet (1.8 m) or more above lower levels was not protected from falling by guardrail systems, safety net systems, or personal fall arrest systems: (a) Mezzanine, Millet Plastics Plant, Lebanon Pennsylvania - The employer allowed employees to construct the leading edge of the floor to the mezzanine with coated 1/2 inch plywood material. The employees were not protected from falling with guardrail systems, safety net systems, or personal fall arrest systems and were exposed to a fall of 16 feet 10 1/2 inches from the mezzanine to the concrete floor below on or about March 4, 2014. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1910.1200(h)(3)(iv): The details of the hazard communication program developed by the employer, did not include an explanation of the labels received on shipped containers and the workplace labeling system used by their employer; the safety data sheet, including the order of information and how employee could obtain and use the appropriate hazard information: (a) Arthur Funk & Sons, Inc. 1405 Birch Road, Lebanon Pennsylvania - Employees use and are exposed to a variety of chemicals including chemical with hazardous characteristics at the various construction worksites managed by the company. Th eemployer did not provide employees with training on the revised hazard communication standard (HCS 2012) label elements and the new format and type of information on each section of the safety data sheets (SDSs) to ensure that when employees begin to see HCS 2012 compliant labels and SDSs in their workplace, employees understand how to use the labels and SDSs and access the information effectively, on or about March 4, 2014. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and state employees and their representatives were informed of this abatement.
