29 CFR 1926.760(a)(1): Each employee engaged in a steel erection activity who is on a walking/working surface with an unprotected side or edge more than 15 feet (4.6 m) above a lower level was not protected from fall hazards by guardrail systems, safety net systems, personal fall arrest systems, positioning device systems, or fall restraint systems.   a) Employees engaged in q-decking installations were not protected from fall hazards while working at unprotected sides or/and edges at the site and the area was not identified as a controlled decking zone.  An employee (the deceased) did not have a harness and other employees were not tied-off when working/walking near the sides/edges.  Employees were exposed to potential fall hazard of approximately 24 ft. to ground below; on or about 3/6/14.

29 CFR 1926.451(b)(1)(i): Each platform unit (e.g., scaffold plank, fabricated plank, fabricated deck, or fabricated platform) was not installed so that the space between adjacent units and the space between the platform and the uprights were no more than 1 inch (2.5 cm) wide, except where the employer can demonstrate that a wider space is necessary.  Location: 105 Metropolitan Ave., Brooklyn, NY.     a) Employer did not ensure that a tubular welded scaffold utilized by employees as means of access and/or to pass q-decking material to the structural steel erection area was fully planked. The top work platform of the three tier scaffold was not fully planked; on or about 3/6/14.  Adar Steel was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.451(b)(1)(i), which was contained in OSHA inspection number 910524, citation number 01, item number 003 and was affirmed as a final order on 11/4/2013, with respect to a workplace located at 2216 Ave L, Brooklyn, N.Y.

29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used.  Cross-braces were used as a means of access.   Location: 105 Metropolitan Ave., Brooklyn, NY.       a) Employer did not ensure that a 3 tier tubular welded scaffold utilized by employees as means of access to the structural steel erection area was equipped with means to access the area safely.  Employees were exposed to fall hazards of up to approximately 24 ft. while climbing the scaffold's cross-braces to access the scaffold's platforms; on or about 3/6/14.  Adar Steel was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.451(e)(1) which was contained in OSHA inspection number 781121 citation number 01, item number002 and was affirmed as a final order on 3/5/2013, with respect to a workplace located at 29-20 Healy Ave, Far Rockaway, N.Y.

29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section.  Location: 105 Metropolitan Ave., Brooklyn, NY.      a) An employee was not wearing a fall arrest system or protected by a guardrail system when he fell from the scaffold's work platform 19ft to his death.   The deceased was using the scaffold to pass q-decking material to the structural steel erection area and to gain access to that area; on or about 3/6/14.  Adar Steel was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.451(g)(1)(vii) which was contained in OSHA inspection number 910524, citation number 01, item number 004 and was affirmed as a final order on 11/4/2013, with respect to a workplace located at 2216 Ave L, Brooklyn, N.Y.
