29 CFR 1926.501(b)(2)(ii): Each employee on a walking/working surface 6 feet (1.8 m) or more above a lower level where leading edges are under construction, but who was not engaged in the leading edge work, was not protected from falling by a guardrail system, safety net system, or personal fall arrest system.   On or about October 30, 2014   Location; Ground floor, entry/exit 155 West 126th Street, New York, NY 10040  A). Employees were exposed to fall hazards in excess of 10 feet to the lower level because they were not protected from falling by means of Personal Fall Arrest System, Guardrails, Safety Nets or Controlled access zone.  The floor at the entry/exit was removed exposing the floor joists and basement below. Employees were utilizing this area as a means of entry/exit into the project.

29 CFR 1926.1052(c)(4): Employer did not ensure Midrails, screens, mesh, intermediate vertical members, or equivalent intermediate structural members were provided between the top rail of the stair rail system and the stairway steps:    On or about October 30, 2014, and again on October 31, 2014.  Location; 155 West 126th Street, New York, NY West structure fourth floor stairway.  a). Employees utilizing stairs to traverse through the project from ground level to the roof, were not protected from falls off the stairs because the stairwells were not protected with midrails, screens, mesh, or intermediate vertical members.

29 CFR 1926.1052(b)(1): Foot traffic was not prohibited on stairways where the treads and/or landings of pan stairs were to be filled in with concrete or other material at a later date and stairs were not temporarily fitted with wood or other solid material at least to the top edge of each pan.Temporary treads and landings used for pan stairs that were to be filled in with concrete or other solid material at a later date were worn below the level of the top edge of the pan.  On or about October 30, 2014 and October 31, 2014  Location: 155 West 126th Street, New York, NY every stair well throughout the project.  Employees were traversing throughout the project using stairwells and were exposed to trip and fall hazards because the stair landing pans were not filled in with a solid material and the material used to fill stair treads had been worn down below the top lip of the tread pan.

Employees were utilizing stairways to traverse throughout the project and were exposed to fall hazards because the Landings were not equipped with handrails.

29 CFR 1926.1052(c)(1)(ii): Stairways having four or more risers or rising more than 30 inches (76 cm), whichever is less, were not equipped with a handrail system along each unprotected side or edge:  On or about October 30, 2014, and again on October 31, 2014.  Location: 155 West 126th Street, New York, NY  a). Employees working on site traversed the west stairs from roof top to street level numerous times daily to complete their work.  Employees were exposed to fall hazards because the stair systems was not equipped with a handrail system along each unprotected side or edge of the stairs  Adar Steel , Inc was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.1052 (c)(1)(ii) Stairways, which was contained in OSHA inspection number 960535, citation number 1, item number 3 and was affirmed as a final order on 10/24/2014, with respect to a workplace located at 2216 Avenue L. Brooklyn, NY 11210.
