29 CFR 1926.651(c)(2):  A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22 m) or more in depth so as to require no more than 25 feet (7.62 m) of lateral travel for employees:  The employer does not provide a stairway, ladder, ramp or other safe means of egress to each employee when working in a trench approximately 7.5 feet deep.      a)  This most recently occurred on March 10, 2014, at 3624 Jenssen Ave., Chicago, Illinois.  Employees are not provided with a safe means of egress when working in a trench approximately 7.5 feet deep.  To abate this hazard in the future, the employer must ensure that safe means of access and egress is provided to employees when working in the trench, and that no employees enter the trench until the safe means of access/egress is provided.    This employer has been cited for this practice that included: OG Plumbing LLC, was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.651(c)(2), which was contained in OSHA inspection number 767522, citation number 1, item number 1 and was affirmed as a final order on January 31, 2013, with respect to a workplace located at N. Damen Ave. & W. Erie St., Chicago, IL 60622.  No abatement certification or documentation is required for this item.

29 CFR 1926.652(a)(1):  Each employee in an excavation is not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(b) or 1926.652(c):    The employer does not protect each employee in its excavations by properly sloping the excavation or by using appropriate protective systems designed in accordance with paragraphs (b) or (c) of 29 CFR 1926.652.      a)  This most recently occurred on March 10, 2014, at 3624 Jenssen Ave., Chicago, Illinois. An employee is exposed to cave-in hazards while installing a water service in a trench that is approximately 7.5 feet in depth without an adequate cave-in protection system.        This employer has been cited for this practice that included: OG Plumbing LLC, was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.652(a)(1) which was contained in OSHA inspection number 826502, citation 1, item 1a, and was affirmed as a final order on March 25, 2013, with respect to a workplace located at 1809 W. Ohio St., Chicago Illinois 60622 and OSHA inspection number 767522 citation 1, item 2a and was affirmed as a final order on January 31, 2013, with respect to a workplace located at N. Damen Ave. & W. Erie St., Chicago Illinois 60622.     Pursuant to 29 CFR 1903.19, the employer must submit documents describing the steps it is taking to ensure compliance, including an explanation of how these steps protect it's employees from excavation cave-ins.

This employer has been cited for this practice that included: OG Plumbing LLC, was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.652(c)(2)(i), which was contained in OSHA inspection number 826502, citation number 1, item number 1b and was affirmed as a final order on March 22, 2013, with respect to a workplace located at 1809 W. Ohio St., Chicago, IL 60622.  Pursuant to 29 CFR 1903.19, the employer must submit documents describing the steps it is taking to ensure compliance, including an explanation of how these steps protect it's employees from excavation cave-ins.
