OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: a) Fralo Industries, 1651 E. 12th St. in Erie, PA - natural gas main located between the building and parking lot. On or about March 4, 2014, personnel were potentially exposed to fire/explosion hazards from natural gas mains and associated piping that were not protected against physical damage. The gas main and associated piping was not protected from being accidentally struck-by vehicles.

29 CFR 1910.22(a)(1): All places of employment, passageways, storerooms, and service rooms were not kept clean and orderly and in a sanitary condition: a) Fralo Industries, 1651 E. 12th St. in Erie, PA; area around parts washer/booth. On or about March 4, 2014, a flammable residue had accumulated on sections of the wash booth in areas that include but are not limited to the light fixtures. A fire erupted on the top of the wash booth while an employee was utilizing a drill on the light fixtures screws. b) Fralo Industries, 1651 E. 12th St. in Erie, PA; powder coating room. On or about March 4, 2014, powder coating material had accumulated on ductwork, piping and other equipment. The accumulation of the powder coat material created a potential fire hazard.

On or about March 4, 2014, employees working on top of the parts washer were not protected from falling 9 feet to the ground by a standard guardrail. Employees performed activities that included, but were not limited to, working on washer booth light fixtures, cleaning the exhaust duct from washer and cleaning after the fire on March 4, 2014. Or In The Alternative: 29 CFR 1910.132(a): Protective equipment was not provided wherever it was necessary by reason of hazards which were encountered in a manner capable of causing injury or impairment in the function of any part of the body: a) Fralo Industries, 1651 E. 12th St. in Erie, PA; top of parts washer booth, east side of production area. On or about March 4, 2014, employees did not utilize and/or were not protected from falling 9 feet to the ground by fall protection equipment (e.g. Personal Fall Arrest System) when working on top of the washer. Work activities performed on top of the washer included, but were not limited to, working on washer booth light fixtures, cleaning the exhaust duct from washer and cleaning after the fire on March 4, 2014.
