29 CFR 1910.101(a): "Inspection of compressed gas cylinders." Each employer shall determine that compressed gas cylinders under his control are in a safe condition to the extent that this can be determined by visual inspection. Visual and other inspections shall be conducted as prescribed in the Hazardous Materials Regulations of the Department of Transportation (49 CFR parts 171-179 and 14 CFR part 103). Where those regulations are not applicable, visual and other inspections shall be conducted in accordance with Compressed Gas Association Pamphlets C-6-1968 and C-8-1962, which is incorporated by reference as specified in Sec. 1910.6.        a. Maintenance Building/Repair Shop - On or about March 26, 2014, the employer had compressed gas cylinders unsafely stored indicating that visual inspections were not conducted at the company. Employees were thereby exposed to struck by hazards. The unsafe conditions of stored compressed gas cylinders were the following;     1. Main Repair Shop - At the middle section there were six (6) compressed oxidizing gas cylinders of oxygen (O2) stored next to one (1) flammable gas cylinder of acetylene (C2H2).      2. Main Repair Shop - At the middle section there were six (6) compressed gas cylinders of oxygen (O2) that were not chained or tied up to prevent them from being knocked over.     3. Main Repair Shop - At the middle section there was one (1) compressed gas cylinder of acetylene (C2H2) that was not chained or tied up to prevent it from being knocked over.     4. Eastside Overhead Door/Main Repair Shop - At the entrance there were six (6) compressed gas cylinders of acetylene (C2H2) that were not chained or tied up to prevent them from being knocked over from moving equipment.

29 CFR 1910.132(c): Design. All personal protective equipment shall be of safe design and construction for the work to be performed.     a. Parts Washer Tank/ Safety - Kleen 105 Solvent - On or about March 17, 2014, the employer did not ensure the adequate safe design of personal protective equipment such as eye protection (chemical goggles) when employees washed/cleaned metal parts in hazardous chemicals.   Employees were thereby exposed to the chemical hazards of Aliphatic Halogenated Hydrocarbons and Alicyclic Hydrocarbons.

29 CFR 1910.1200(f)(8): The employer shall not remove or deface existing labels on incoming containers of hazardous chemicals, unless the container is immediately marked with the required information.     a. Truck Wash Up Area - On or about March 26, 2014, the employer had two (2) plastic (225 gallon) containers containing corrosive mixtures (sulfuric acid, sodium hydroxide, and hydrofluoric acid) with labels that were defaced and not legible. Employees were thereby exposed to the chemical hazards of corrosive substances.

29 CFR 1910.1200(h)(3)(iv): The details of the hazard communication program developed by the employer, including an explanation of the labels received on shipped containers and the workplace labeling system used by their employer; the safety data sheet, including the order of information and how employees can obtain and use the appropriate hazard information.   a. Main Repair Shop - On or about March 26, 2014, the employer's training content program for employees required to  work with hazardous chemicals did not include the details of the hazard communication program. Employees were thereby exposed to the hazards of flammable, corrosive, and combustibles chemicals. The missing information for the specific job tasks were the following;    1.  Employees required to wash/clean metal parts at the vat/tank (tetrachloroethylene and petroleum distillates) were not given appropriate hazard information regarding eye protection such as chemical goggles from the safety data sheet.   2.  Employees required to wash/clean trucks using chemicals from containers (hydrofluoric acid, sulfuric acid, and sodium hydroxide) with defaced labels were not given information on the explanation of the adequate workplace labeling system.    3.  Employees required to store compressed gas cylinders (oxygen and acetylene) around the shop were not given information on how to obtain and use the appropriate hazard information.
